PUBLIC NOTICE NOTICE TO ENTER AND CARRY OUT WORKS AT 11 HEATON STREET, AWABA Notice to Enter and Carry Out Works pursuant to Order under Schedule 5, Part 1 of the Environmental Planning and Assessment Act 1979. An Order dated 4 October 2023 was given by Council under the provisions of Section 9.34 of the Environmental Planning and Assessment Act 1979 (the 'Act') to the owner of the property known as 11 Heaton Street, Awaba NSW 2283 (Lot A DP 371352) (the 'premises'). The owner has failed to comply with the Order. Council hereby gives notice that, commencing at any time from 7am on the date which is 14 days from the date of this notice, it will do all such things as it considers necessary or convenient to give effect to the terms of the Order. This may include but is not limited to entering the premises and carrying out any work required under the Order, as authorised under clause 33 of Schedule 5 of the Act. Council will continue to do those things until such time as the terms of the Order have been met to Council's satisfaction and at its absolute discretion. Council also intends to recover any costs and expenses incurred (less the proceeds, if any, of any sale of any materials under Schedule 5, Part 11 of the EPA Act) in connection with the Order from the owner.
